Terms of Service

These Terms govern your access to and use of Retard or Not, the website, public Target Handle pages, voting and mark features, paid market actions, and related services that link to these Terms (collectively, the "Service"). "We," "us," and "our" refer to the operator of the Service.

By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Retard or Not is explicitly a public group performance art piece, satirical account-level crowd-rating, parody/opinion surface, and paid-market game about public X/Twitter accounts. The Service lets people view public Target Handle pages, see aggregate game-state, and, where enabled, sign in to cast Marks or buy paid game effects.

For these Terms:

• A "Target Handle" means the public X/Twitter account handle being viewed, rated, marked, or affected by the Service.
• A "Signed-In User" means a person authenticated through X/Twitter using Clerk or another supported identity provider.
• A "Mark" means a Signed-In User's current constrained vote state for a Target Handle.
• A "Paid Action" means a paid game mechanic, package, or market effect purchased through the Service.
• A "Market Listing" means a public record of a Paid Action's Target Handle, effect, amount, status, and timing.
• "Retard" is product/parody acronym language meaning Respected, Educated, Talented, Accomplished, Responsible, Disciplined.
• "Retarded" is product/parody acronym language meaning Respected, Educated, Talented, Accomplished, Responsible, Disciplined, Edifying, Demure.

The Service is not affiliated with, endorsed by, or sponsored by X Corp., Twitter, or any similar platform unless we expressly say otherwise.

2. Eligibility

Public browsing may be available without sign-in where lawful. You must be at least 18 years old to sign in, cast Marks, change Marks, clear Marks, or buy Paid Actions. By signing in, casting or changing a Mark, clearing a Mark, or buying a Paid Action, you represent that you are at least 18 years old and may legally use the Service. X/Twitter account eligibility does not lower or replace this 18+ requirement.

We may deny, suspend, or restrict access for bots, automation abuse, suspended users, users evading enforcement, users who create legal, safety, payment, platform, or operational risk, or anyone else where we reasonably believe restriction is appropriate.

3. Target Handle Eligibility

Only public X/Twitter accounts are eligible to appear as Target Handles. Private, protected, deleted, suspended, unavailable, access-restricted, or otherwise inaccessible accounts are not eligible. If a Target Handle later becomes private, protected, deleted, suspended, unavailable, access-restricted, or otherwise inaccessible, we may hide, restrict, remove, freeze, or prevent Marks and Paid Actions on that Target Handle.

The Service does not knowingly allow Target Handles operated by, primarily associated with, or reasonably believed by us to be associated with minors. We may hide, restrict, remove, freeze, or review any Target Handle that appears to be minor-associated, safety-sensitive, high-risk, private-person-associated, or otherwise inappropriate for the Service.

A Target Handle being public on X/Twitter does not guarantee that it will remain eligible for Retard or Not.

4. Opinion, Parody, Satire, And No Factual Claims

The Service is for entertainment, parody, satire, opinion, public group performance art, absurdity, and game mechanics. Ratings, Marks, aggregate results, verdict-style labels, charts, Paid Actions, Market Listings, and other public game-state are parody/opinion/game outputs about public account-level activity or posting persona.

Users vote on the Target Handle and public X/Twitter account as an account-level game object. Users do not vote on the person or persons who own, operate, appear in, speak through, are identified by, or are associated with that account.

They are not factual claims about the human being behind an account. They should not be treated as statements about identity, health, medical or clinical status, intelligence, morality, professional competence, criminality, disability, protected status, real-world conduct, or any other factual attribute of a person.

Some parts of the Service may use terms such as "verdict" or similar product language. Those terms are parody, opinion, and game-state labels only. They are not factual determinations.

5. Marks And Vote Privacy

Individual Marks are private in the public UI at launch. Aggregate counts and public Target Handle results may be public.

A Mark is a constrained game input on a Target Handle, not on any person. It is not a public free-text statement, accusation, comment, message, or factual claim. The Service does not provide public comments, direct messages, public free-text posts, user bios, user-uploaded media, user-created accusations, or user-to-user communication.

New Marks may become public later only if voter-reveal features are enabled and clear notice is given before the user acts. Existing private-launch Marks will not become public automatically after a policy change. A private-launch Mark can become public only if the Signed-In User affirmatively opts in or changes or casts a Mark after clear voter-reveal notice.

You should not cast a Mark unless you are comfortable with it being retained and processed under the rules shown to you when you act. If Mark removal is enabled, you may be able to clear your own existing Mark.

6. Paid Actions, Market Listings, And Purchases

Paid Actions may include Tactical Votes, Boosts, Stop Voting, counters, Score Resets, Spins, or other configured paid packages. Paid Actions are two-sided, symmetric game mechanics where the product supports paired effects. A paid effect that moves game-state in one direction may have a corresponding opposite-direction mechanic or counter-effect.

Paid Actions are paid game effects, market effects, or paid actions. They are not organic Signed-In User Marks, synthetic user votes, synthetic user identities, factual endorsements, or factual accusations. A Paid Action purchases a game or market effect at the time of purchase. It is not a permanent result, permanent listing, permanent Target Handle availability, permanent public state, or guaranteed future voting condition. The Service may display Paid Actions and organic Marks separately or otherwise label them so users can understand the difference between organic constrained Marks and paid market effects.

Market Listings may publicly show a Paid Action's Target Handle, effect, amount, status, timing, and related game-state metadata. Buyer identity is not public by default. Operators may access buyer identity internally for support, fraud, payment disputes, legal compliance, safety, and enforcement. Buyer identity may be disclosed only if the buyer explicitly opts into attribution, the Service is legally required to disclose it, or disclosure is needed for payment, fraud, legal, safety, or enforcement handling.

Stripe Checkout is the expected first payment provider. Payment processing is handled by Stripe and is subject to Stripe's terms and privacy practices. A checkout redirect alone does not guarantee that a Paid Action will settle; the Service backend determines whether and how the product effect applies.

Paid Action purchases are final once successfully settled because they can immediately affect public game-state. If a Target Handle is later hidden, removed, restricted, frozen, made ineligible, or otherwise changed for any reason, settled Paid Actions on that Target Handle are not eligible for refund on that basis. Refunds are available only where required by law or granted at our discretion. A refund, chargeback, payment dispute, or payment reversal does not automatically unwind the public product effect. We may separately reverse, hide, adjust, or leave the paid effect in place depending on abuse, safety, fraud, legal, payment, and product-integrity concerns.

Fraudulent, abusive, disputed, or charged-back purchases may lead to suspension, termination, loss of Paid Action access, reversal of paid effects, or other enforcement.

7. User Conduct

You may not use the Service to:

• violate the law or another person's rights;
• harass, threaten, stalk, dox, or target private individuals;
• target or attempt to target minors;
• impersonate anyone or misrepresent affiliation;
• attack, interfere with, scrape excessively, reverse engineer protected systems, bypass access controls, or disrupt the Service;
• use bots, credential stuffing, automated voting, or coordinated manipulation outside product-permitted paid mechanics;
• evade rate limits, enforcement, payment controls, safety controls, or Target Handle eligibility rules;
• submit illegal, defamatory, privacy-invasive, exploitative, or rights-infringing material through support, removal, privacy, legal, or moderation channels.

The Service may be adversarial, comedic, absurd, and market-like, but the joke does not permit threats, doxxing, harassment, illegal conduct, abuse of private individuals, or targeting of minors.

8. Moderation, Removal, Appeals, And Operator Powers

We may hide Target Handles, hide users, adjust counts, apply Target Handle policies, remove seed activity, suspend features, reverse paid effects, restrict Paid Actions, remove or restrict minor-associated handles, or otherwise enforce these Terms. We may act to reduce legal, safety, abuse, platform, payment, fraud, privacy, or operational risk.

A Target Handle owner, parent, guardian, authorized representative, or person with a credible safety or privacy concern may request removal, restriction, review, or other assistance. Verification through the same X/Twitter account may be one way to confirm control of a Target Handle, but we may consider other verification methods where appropriate.

Approved Target Handle removal should stop the Target Handle from being publicly viewed and voted on, subject to records retained for legal, safety, fraud, payment, audit, abuse-prevention, settlement-integrity, public count coherence, or operational reasons.

9. Account Deletion

You may stop using the Service at any time. You may request deletion of your Signed-In User account and associated personal data by contacting us at the contact listed in these Terms.

Account deletion may delete, hide, or de-identify associated user data where practical and legally appropriate. Termination or deletion does not necessarily delete public, aggregate, historical, audit, payment, fraud, safety, legal, abuse-prevention, or settlement-integrity records. Financial transaction records, payment dispute records, paid-action records needed for settlement integrity, and related compliance records may be retained after account deletion.

After account deletion, old Marks should be deleted or de-identified from your Signed-In User identity where practical, while retaining minimal aggregate, audit, fraud, verdict-history, abuse-prevention, and settlement-integrity records needed to keep public counts and paid-action history coherent.

10. Third-Party Services

The Service depends on third parties such as Clerk, Convex, Stripe, PostHog, Sentry, SocialData, Vercel or other hosting providers, and X/Twitter profile data sources. Third-party terms and privacy practices may apply. We are not responsible for third-party outages, data, policies, or conduct.

Vendor-specific detail belongs primarily in the Privacy Policy, while these Terms may name major dependencies relevant to identity, payments, hosting, analytics, profile data, or infrastructure.

11. Intellectual Property And License

The Service, code, branding, design, product mechanics, copy, and interfaces are owned by us or our licensors. You receive a limited, revocable, non-exclusive, non-transferable right to use the Service under these Terms.

Public X/Twitter profile information remains associated with its original source or rights holder. These Terms do not give you ownership of the Service or third-party platform content.

No public free-text user content, comments, direct messages, user bios, user-uploaded media, user-created accusations, or user-to-user communication are planned. User inputs are limited to constrained actions such as Marks, Target Handle inputs or searches, Paid Action selections, and direct support, removal, privacy, legal, or moderation communications.

You grant us a worldwide, non-exclusive, royalty-free license to host, use, display, process, transform, archive, reproduce, share, and create derivative works from Marks, Target Handle inputs, Paid Action selections, and other submissions as needed to operate, improve, protect, enforce, and promote the Service, subject to the Mark-privacy and deletion rules in these Terms and the Privacy Policy.

12. Disclaimers

The Service is provided "as is" and "as available." We do not guarantee that the Service will be uninterrupted, secure, accurate, available, error-free, or fit for any particular purpose.

We do not guarantee that Target Handle pages, aggregate counts, verdict-style labels, charts, Paid Actions, prices, Market Listings, or history are accurate, complete, current, or stable. They may change because of user activity, Paid Actions, operator actions, corrections, enforcement, abuse review, technical issues, or product changes.

The Service is entertainment-only, parody, satire, opinion, absurd game mechanics, and public-account game-state. It does not provide factual determinations about people or accounts.

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

13. Limitation Of Liability

To the fullest extent permitted by law, we will not be liable for indirect, incidental, consequential, special, exemplary, punitive, or lost-profit damages, or for loss of data, goodwill, reputation, use, or business opportunity.

To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the Service or these Terms will not exceed the the amount you paid to the Service in the six months before the claim.

Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.

14. Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold us harmless from claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys' fees, arising from your misuse of the Service, violation of these Terms, violation of law, violation of another person's rights, fraudulent or abusive purchases, chargebacks, or submissions to the Service.

Final indemnity language should be reviewed by counsel.

15. Changes To The Service Or Terms

We may change, suspend, or discontinue any part of the Service at any time. We may update these Terms by posting a revised version. Continued use after changes become effective means you accept the updated Terms.

For material changes, we will use reasonable notice such as posting, in-app notice, or email where we have an email address from direct user communication. Stripe receipt emails remain handled by Stripe.
